Terms and conditions

In this document you will find all the information on the marketing of the seminars and courses, specifically the course “Training in optical diagnosis of early colorectal cancer” (hereinafter referred to as the “Course“), which can be taken online. Interested parties (hereinafter referred to as “Participants“) may obtain additional information on the course content and course development by accessing the course description on the website.

1. About the website

In compliance with Law 34/2002 on Information Society Services and Electronic Commerce (LSSICE), we inform you that the ownership of the domain of the website corresponds to the Gastrointestinal Oncology, Endoscopy and Surgery research group (hereinafter, “GOES Group”) belonging to ALTHAIA, XARXA ASSISTENCIAL UNIVERSITÀRIA DE MANRESA, FP. (hereinafter, “ALTHAIA”).

The purpose of these General Terms and Conditions of Sale Online (hereinafter, the “Terms“) is to regulate the provision of information and commercial transactions between the GOES Group and the users of the domain www.goesresearchgroup.com (hereinafter, the “Website“).

2. About the course

This specialised training aims to improve the early detection of colorectal cancer in lesions detected during colonoscopy. The course will be delivered in English and has an intensive duration of 25 (twenty-five) hours. The theoretical and practical content of this course is aligned with the recommendations of international guidelines such as the European Society of Gastrointestinal Endoscopy, the American Society for Gastrointestinal Endoscopy and the Japan Gastroenterological Endoscopy Society.

The Course is divided into Modules (for both Basic and Premium subscriptions) containing multiple online exercises with images and videos recorded by an international panel of expert tutors. Each Module contains an “Introduction” which includes the objectives and key points of the section; you will also find a Learning by doing” section where Participants are given the opportunity to deepen their understanding of the main points of the Module through various exercises with feedback from the tutors. Before the end of each Module, the section “To know more” offers additional resources and exercises for the Participant to consolidate the knowledge acquired.

Participants who complete all the modules, activities and the final test will receive a certificate endorsed by the Spanish Association of Gastroenterology and the Spanish Society of Digestive Endoscopy and issued by GOES Group. It should be noted that this certificate only attests to the successful completion of the course, but does not attest to the acquisition of new knowledge or skills that can be implemented in clinical practice.

3. How to register on the course?

The registration process for the Course will be entirely online. To do so, interested Participants must register as users by clicking on the “Enroll now” section; they must then complete a form in which basic personal data will be requested, such as full name, ID card or ID number, email, among others.

The course is aimed at physicians with expertise in colonoscopy, mainly endoscopic gastroenterologists, gastroenterologists (in Spain) and surgeons (in other countries). It is recommended that physicians interested in taking the course have performed at least 300 colonoscopies independently. These colonoscopies can have been performed during the physicians’ years of residency, as an exercise to obtain their speciality or in their regular practice.

The course is an ongoing research project with public funding, and as such requires a first phase of validation or “validation study” to demonstrate that the learning objectives set out a priori are met. Consequently, the first edition of the course will have no cost for the Participants, however, only physicians individually invited by GOES Group will be able to access.

GOES Group may make such amendments to these Terms as it deems appropriate. In the event of such a change after the start of the service, the Participant will be duly informed at the contact email address provided by the Participant at the start of the contractual relationship.

4. Price and payment

The price of the course is indicated in the course description on the website and is expressed in the official currency of the Economic and Monetary Union of the European Union (€).

Value Added Tax (VAT) is expressly included in the price.

The price may change at any time, but any changes will not affect purchases, discounts or promotions in respect of Participants who have been sent a confirmation or access to the Course.

The total amount of the Course will be paid in one single payment, however, Participants can change from Basic to Premium mode by making the corresponding differential payment.

Promotions or discounts will be applied where applicable, using a discount coupon provided by GOES Group.

You may use the credit or debit cards identified on our Website as a means of payment. Our Website uses RedSys as a payment gateway, which guarantees a 100% secure purchase for Participants. All transactions involving the transmission of personal or bank details are carried out using a secure environment. By clicking “Enroll now” you are confirming that the credit or debit card is yours.

To minimise the risk of unauthorised access, your credit or debit card details will be encrypted. Credit or debit cards will be subject to checks and authorisations by the credit or debit card issuer, but if the credit or debit card issuer does not authorise payment, we will not be liable for any delay or non-delivery and will not be able to enter into any contract with the Participant.

5. Moodle virtual platform

Upon confirmation of enrolment and payment, the GOES Group will proceed to enrol the Participant by providing a username and password to access the Moodle virtual platform. The username will correspond to the ID number, the Participant will be able to select the password they wish.

The virtual platform Moodle is a teaching tool for the registered Participants, which will allow, among other functions, communication between the Participants and the teaching staff.

In addition, this tool provides Participants with a space for the following activities: personalising and adjusting their profile, a notice section, sending and receiving messages, participation in groups, forums and access to shared files.

6. Access to the course

Participants must have an electronic device (computer or tablet) connected to the internet in order to access the Course. Access will be immediate and unlimited to the contents and benefits of the Course by using the username and password designated to each Participant.

Before starting the Course, Participants will be encouraged to watch a multimedia video in order to get an overview of the Course, after which they will have to answer some questions based on the images they saw. Once the Participants have completed the quiz, they will be ready to start the Modules. At the end of the Course, Participants will be asked to answer the same image-based questions to assess their experience and measure how the Course influenced their learning.

GOES Group makes available to Participants the viewing and downloading, as appropriate, of multiple online exercises with images and videos recorded by an international panel of expert tutors, and Participants can find various materials such as interviews, guides, PDF documents, worksheets, among other digital content continuously updated.

Although the Course is conducted entirely online, Participants who have purchased the Premium subscription are offered the opportunity to schedule two face-to-face online meetings in advance with one of the members of the tutor panel. These meetings will be limited to a maximum of 10 (ten) Participants to discuss any queries that may have arisen. Participants will be able to choose between different dates and times; Modules 1 to 5 will be discussed at the first meeting and Modules 6 to 10 at the second. The meetings will be held via the Google meet platform, the link to access will be sent to each Participant at the beginning of each meeting.

It is important that Participants attend the meetings to clarify any doubts or questions that may have arisen during the course, the meetings will be recorded for 30 days or for as long as the GOES Group may decide.

It should be noted that recordings of the meetings will be made so that Participants who are absent, unable or unwilling to attend will have access to the meetings for such time as the GOES Group may determine. Such recordings shall not be used for purposes other than the above.

During the month following the completion of the last Module of the Course, Participants with a Premium subscription will be able to upload videos of lesions they have analysed in their regular clinical practice to receive personalised feedback from one of the tutors.

7. Participants’ obligations

The Participants undertake to:

  1. Enter their complete, accurate and updated data at the time of registration and purchase of the Course. GOES Group is not responsible for the veracity of the registration data provided by the Participants, so each Participant is responsible for the possible consequences, errors and failures that may subsequently arise from the lack of accuracy of the data.
  2. Keep your account username and password secure and secret. This password is personal and non-transferable. In case of loss or theft of the password, the Participant shall immediately notify the GOES Group, otherwise the Participant shall be liable for the uses applicable to his/her account up to that time.
  3. Participants may not register more than once, unless authorised by GOES Group, and may not transfer or share their account with third parties.
  4. Under no circumstances, distribute, transmit, copy, display, perform, reproduce, license digital content (videos, interviews, guides, PDF documents, worksheets and links of interest) shared or provided by GOES Group, as well as information provided through group sessions.
  5. To use the information contained in the Moodle virtual platform exclusively for their own needs and not directly or indirectly carry out any type of commercial exploitation of the contents and materials to which they will have access after purchasing the Course.
  6. Not to use the images or videos of GOES Group or third parties (e.g. other GOES Group Participants or partners) to which they may have access during the execution of the Course content for their own purposes (e.g. upload the content to social networks or any other media), without the express consent of GOES Group or such third parties.

In group sessions, where Participants may express their opinions and comments, as well as engage in interactive communication with other Participants, the following rules of conduct shall be observed:

  1. It is strictly forbidden to harass, violate, threaten or cause annoyance to any other Participant of the meeting given by GOES Group. Under no circumstances may any information, data, text, files, links, programmes, communications or any other material which is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, racist or ethically incorrect, or which constitutes sexual harassment or harassment on the basis of sex be sent.
  2. Do not send or write any advertisements, promotional or advertising materials during the session.

GOES Group reserves the right to terminate access to the Course, if it considers that Participants do not comply with the provisions of these Terms.

8. GOES Group’s obligations

GOES Group is committed to:

  1. Provide a username and password to each Participant for access to the contents of the Course.
  2. Guarantee the Participants that the entire contents of the Course are absolutely original and that it has full intellectual property rights over them.
  3. To certify that the Course and its contents do not violate any regulation, contract, right, interest or property of third parties.
  4. To protect Participants’ personal data and not to use or process their data for any purpose without their consent, unless such use or processing is necessary for the provision of the service. In any case, the express consent of the Participants will be requested for specific uses, such as group sessions, transfer of image rights and testimonials.
  5. Communicate or notify Participants in a timely manner of the dates and times of group meetings.
  6. Not to use recordings of online sessions or meetings for any purpose other than to inform the absent Participant of what has been discussed in the online sessions or meetings.
  7. To make the necessary modifications to the contents of the Course so that the Participants can obtain updated and accurate information at all times.

9. Right of withdrawal and return policy

As a consumer, the Participant has the right to withdraw from the product or service within 14 (fourteen) calendar days, without giving any reason. The withdrawal period will expire after 14 (fourteen) calendar days from the day the Course was purchased, prior to the actual performance, i.e. access and/or download of the digital content.

If this right is exercised within 14 (fourteen) calendar days, GOES Group will refund, within a maximum period of one month, the amount of the registration fee actually paid. The refund will be made by the same method of payment used by the Participant to pay the Course fee.
The Participants’ right of withdrawal is excluded in any case in accordance with the provisions of the General Law for the Defence of Consumers and Users for products and services, in the following case:
In the case of digital content (Modules, videos, interviews, guides, PDF documents, worksheets, e-books, etc.) and performance has begun, i.e. when Participants have accessed or downloaded any Course content, their right of withdrawal will be lost.

Important: Participants will have immediate access to the content of all the Modules as soon as they have paid for the Course.
Without prejudice to the above, the Participant may request a total or partial refund of the Course fee in exceptional cases, which will be studied on a case-by-case basis, by contacting info@trainingopticaldiagnosis.com.

10. Processing of personal data

GOES Group informs that all personal data provided in the purchase form and group meetings will be treated confidentially and in accordance with the provisions of the Organic Law 3/2018 of 5 December on the Protection of Personal Data and guarantee of digital rights, as well as Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data. More information can be found in our Privacy Policy.

Data Controller:

The personal data provided will be processed by Althaia, Xarxa Assistencial Universitària de Manresa, FP, with tax identification number CIF. G58286303 and domiciled at Carrer Dr. Joan Soler, 1-3 – 08243 Manresa (Barcelona), as Data Controller.

Purpose of processing:

We collect personal data to manage the online purchase and access to the Course. We may also send you information, via email, with details of the group session, news related to the Course and its content, updates and teaching information, artificial intelligence to analyse, among other things, the effectiveness of the Course, invitations to conferences that may be of interest to the Participant.
The personal data provided will be kept for the time necessary to comply with legal and contractual obligations in accordance with the regulations in force at any given time.

Data category:

The data processed are those provided by the Participant through the purchase form, specifically: (i) Identification data; name and e-mail address, (ii) Financial data; billing address, name of the cardholder, card number, code and expiry date and (iii) any other type of personal data that may be generated during the development and execution of the group sessions.

It is important that in the case of videos or digital content uploaded by the Participants, whether for discussion with the tutor or, where appropriate, as an example in group meetings, the patient data shown must be fully anonymised, i.e. patient’s name, date, time and place of the colonoscopy. In the event that the video is uploaded in DICOM format, it is the Participant’s responsibility to record it in MP4 format or any other format whose file does not contain encrypted personal data. In this sense, it is the Participant’s responsibility to upload the digital content without the patient’s identifying data by duly editing the videos or content. Consequently, the GOES Group is not responsible for the violation of the right to privacy and confidentiality that may be infringed between the doctor-patient relationship, its derivations and possible legal consequences.

Legitimation for data processing:

Data is processed on the legitimate basis of the execution of a contract and the consent of the Participant by completing the RedSys transaction form. Should the Participant object and not consent to the processing of their personal data, we will not be able to provide them the service.

Data recipients:

Your personal data will not be disclosed to third parties except when required to do so by law or with the Participant’s consent. In order to provide you with an adequate service, GOES Group may disclose your data to trusted suppliers who will process your data under the sole control of GOES Group. Rights:

Participants may revoke the consent provided and/or exercise their rights of access, rectification, deletion, opposition, limitation of processing and/or data portability by writing to dpd@althaia.cat.

11. Intellectual and industrial property

The Website, the Course and all its contents (including, but not limited to, trademarks, logos, texts, guides, photographs, icons, images, graphics, technology, links, digital, audiovisual or sound contents, as well as graphic design, source code and other software elements contained in this Website and in the access to the contents of the Moodle virtual platform in which the Course is contained) are owned by GOES Group and have been duly licensed. Source code and other software elements contained in this Website and in the access to the contents of the virtual platform Moodle, in which the Course is contained, are owned by GOES Group and have been duly licensed in its favour, the same, are subject to intellectual and industrial property rights protected by Spanish legislation. Therefore, Participants who wish to exploit the Website, the Course or its contents (reproduce, transform, communicate, etc., beyond the activities authorised by the Intellectual Property Law), should obtain our prior written consent (contact details at the head of this document), regardless of the purposes for which they wish to do so.

Likewise, it is forbidden to remove the GOES Group’s identification data as the holder of the Intellectual and Industrial Property rights of the Website and its respective contents, as well as to take pictures of the technology, tarnish, stain or damage the brand by other means.

The fact that we do not request you to cease unlawful use or use of the content contrary to these Terms shall in no way be construed as consent or authorisation for such use. Nor does it constitute a waiver of any legal action that may be available to us.

12. Limitation of liability

GOES Group cannot be held responsible for any breach of these Terms, whether by error or omission in the contents, by the actions of the Participants, by the particular decisions they may take on the recommendations made or by the transmission of any malicious software that occurs despite having taken the necessary technological measures to prevent it.

In the case of links to external websites of third parties that may be cited in the contents of the Course, this will be done exclusively as an example. Under no circumstances does this party exercise any control over these websites, and no liability is accepted in this respect.

Neither party shall be liable for delays, interruptions or failure to provide the contracted services when this happens due to third parties, as well as when such delays, interruptions or failure to provide services is due to force majeure, technical failures or breakdowns of services provided by third parties, strikes, catastrophes, etc. Force Majeure shall include any act, event, default, omission or accident beyond our reasonable control.

Important: The Course and its digital contents do not constitute medical advice and/or medical diagnosis for Participants and/or their patients. The Course is for informational, academic and self-study purposes only. Viewing the digital content, downloading the information provided by GOES Group or transmitting the information via the Moodle platform does not constitute a doctor-patient relationship. The information that Participants access through the Course is not intended as a substitute for proper medical indications, diagnosis or treatment. Participants shall, at all times and at their own risk, put into practice their own knowledge and, where appropriate, the knowledge acquired in the Course in the event of any query, question or situation they may have with regard to a medical condition of their patients.

Use of the Course content constitutes acknowledgement and acceptance of these limitations and disclaimers.

13. Modifications

GOES Group reserves the right to modify the commercial offer presented on the Website (changes in prices, courses, promotions and other conditions of the services) at any time.

14. Applicable law and jurisdiction

The use of our Website and contracts of sale through it shall be governed by Spanish law.

Any dispute arising out of or in connection with the use of our Website or such contracts shall be subject to the non-exclusive jurisdiction of the courts and tribunals of Manresa. The use of our services implies express acceptance of the jurisdiction of Manresa. As you are contracting as a consumer, nothing in this clause shall affect your rights as a consumer under current legislation.
